How is a “commercial enterprise” defined by the USCIS?


Foreign nationals applying for EB-5 visa should understand that they are making contributions to the U.S. economy by investing in commercial enterprises. The U.S. Citizenship and Immigration Services (USCIS) define a commercial enterprise as a kind of legal business designed to generate profit.

Foreign nationals who have decided to invest a capital of $500,000 or $1 million may engage in certain types of businesses, such as a sole proprietorship, partnership, joint venture, holding company, corporation, or any publicly or privately held businesses that already exist. The USCIS also requires foreign investors to maintain at least ten full-time eligible employees who are qualified to work in their chosen commercial enterprise.
