Requirements for EB-2 / EB-3 Specialist Visa


To obtain an EB-2 / EB-3 Specialist Visa, you must provide proof of outstanding ability in your field of activity. Also, you must demonstrate that: 

You have a diploma of higher education or long-term and relevant work experience in the specialty (required for EB-2 only).

You have received a job offer from an employer in the United States.

You must complete a labor certification process approved by the US Department of Labor.

The employer submitting the petition must have sufficient free funds to pay your salary set by the US Department of Labor.

The employer must conduct a recruiting campaign, interview American candidates for the position of the beneficiary, and show that none of them is qualified to take the position.

Processing Times for EB-2 /  EB-3 Specialist Visa Applications


Obtaining an EB-2 or EB-3 work visa is a long process, consisting of the following steps:

obtaining a labor certificate in the US Department of Labor (the process takes about a year);

consideration of an application (petition) at the US Immigration Service (8-9 months or from 15 days in case of payment of an additional state duty for an expedited review);

 passing an interview and obtaining a visa at the US consulate (in order of priority) or applying for a change of status if the applicant is already in the US (8-10 months).

Getting A Green Card Through EB-2 / EB-3 Specialist Visa


If you receive an EB-2 or EB-3 work visa, you will be issued a green card that gives you the right to work in the United States with any employer. After applying for a green card, you are provided with temporary documents (permission to enter and work), since a green card is issued on average 1.5 years. It will be possible to apply for US citizenship 5 years after receiving a green card.

There are also a few other things to take into consideration when it comes to EB-2 / EB-3 visa.
